34th Circuit Court

Judge Michael J. Baumgartner presided in 34th Circuit Court, Roscommon, Oct. 11:

David C. Rozenski Jr., 26, Westland, pleaded guilty to possession of less than 25 grams of a controlled substance. Dismissed were charges of possession of a non-narcotic and driving while intoxicated, third offense. Rozenski will be sentenced later.

Ross E. Munger III, 19, Warren, failed to appear at a pretrial hearing on a charge of first degree criminal sexual conduct and a bench warrant was authorized. The warrant was ordered to be held until Oct. 25 and if Munger does not appear by that date then it will be issued.

Michael J. Guay Jr., 46, Grayling, charged with driving while intoxicated, third offense, is ready for trial, which was set for Dec. 8.

Christopher Hamilton, 43, Roscommon, who had been sentenced on charges of possession of firearms and domestic violence, filed a motion for clarification and it was granted in part and denied in part.

Robert E. Newsome, 36, St. Helen, charged with possession of marijuana, is ready for trial, which was set for Jan. 12, 2012.

Brian E. Bennett, 33, Prudenville, stood mute to a charge of domestic violence. A pretrial was set for Nov. 22.

Dale E. Kirchoff, 62, Grayling, pleaded guilty to driving while intoxicated, second offense (amended from third offense) and will be sentenced Nov. 22. Dismissed was a charge of driving with a suspended license.

Kenneth L. Bailey, 52, Roscommon, pleaded guilty to driving while intoxicated, second offense (amended from third offense) and will be sentenced Nov. 22. Dismissed were charges of driving with a suspended license and transporting open intoxicants.

William O. Thomas, 25, Houghton Lake, pleaded guilty two counts of probation violation stemming from a conviction on a larceny charge. The judge signed an order amending probation.

Leon J. Bowman, 42. Gwinn, was taken into custody and his bond revoked. He will be held without bond until sentencing Oct. 25 on a first degree criminal sexual conduct charge.

Scott A. Leonard, 43, Roscommon, pleaded no contest to a charge of larceny by conversion less than $1,000 and will be sentenced Nov. 22. Dismissed was a charge of false pretenses between $1,000 and $20,000.

Jason W. Fischer, 35, Roscommon County Jail, requested time to file a motion and a pretrial was reset for Oct. 25 on charges of resisting and obstructing police, felonious assault, possession of weapons by a felon, felony firearm, unlawful imprisonment and criminal sexual conduct with intent to commit sexual penetration and two counts of bribing/ intimidating a witness.

Thomas W. Fisher, 26, Ellsworth, charged with resisting and obstructing police and domestic violence, is ready for trial, which was set for Dec. 6.

John W. Furlong, 44, Tecumseh, was sentenced on a charge of failure to pay child support to a one-year delay of sentence, 12 months probation, $100 in fines and costs, a $100 attorney fee and $198 in other court assessments.

James L. Bowman, 45, Merritt, received an amended judgment of sentence and is to remain on electronic tether until Nov. 2.

Bernard S. Soltis, 52, Prudenville, charged with delivery/manufacture of marijuana, is ready for trial, which was set for Dec. 8.

Civil case heard: No. 11-72-9382, Elizabeth Fortino vs. Michigan Secretary of State, petition for restoration of driver’s license was granted.

Matteson, vs. April Downs, Houghton Lake, failure to carry no-fault insurance complaint; No. 9417, Porath Contractors, Inc., Houghton Lake, vs. Cumberland Princess Partners, LLC, also known as Cumberland Princess Partner, also known as Northstar Fund II, LLC, Brighton, unjust enrichment, quantum meruit and conversion; No. 9420, Barbara L., Rosbury, Traverse City, vs. Hastings Mutual Insurance Company an Citizens Insurance Company of America, violation of the Michigan No-fault Act, declaratory relief; No. 9421, Maurice D. and Marjorie Foltz Trust and trustee Kit Dimambro vs. John Lavere, land contract forfeiture complaint; No. 9422, Lake Township vs. Darla Fox, Houghton Lake, violation of township ordinance complaint; and No. 9425, Brenda Look, Holt, vs. Gerald Brunn, Houghton Lake, complaint for equitable relief, unjust enrichment and conversion.
