34th Circuit Court

Judge Robert W. Bennett presided in 34th Circuit Court, Roscommon, Feb. 21:

Brian K. Panek, 33, Hersey, was sen­tenced on charges of purchasing or pos­session of ephedrine/pseudoephed­rine to make methamphetamine and posses­sion of meth to 12 months in jail on each count (to be served concurrently) with credit for 58 days, and a total of $826 in court assessments.

Thomas J. Walkup, 41, Higgins Lake, was sentenced to two concurrent terms of 12 months in jail (credit for 53 days on one count and credit for two days on the other) and a total of $2,446 in court as­sessments and $60 in restitution. He had pleaded guilty to delivery of less than 50 grams of a controlled substance and lar­ceny in a building.

Daniel R. Brownell, 47, Flushing, pleaded guilty to two counts of use of a controlled substance (non-narcotic) and one count of driving while intoxicated, as amended, and pleaded guilty to ab­sconding/ forfeiting bond. He will be sentenced March 21.

Shannon J. Henshaw, 41, Flint, pleaded guilty to possession of a fi­nancial transaction device by fraud, as amended, and will be sentenced March 21. Dismissed was a charge of third de­gree retail fraud.

Jamie L. Workman, 36, Prudenville, pleaded guilty to probation violation and was sentenced to 30 days in jail (credit for seven days). Workman will be dis­charged from probation without im­provement. The probation stemmed from a conviction on a charge of operating a lab near a minor.

Christopher G. Walkup, 44, Hough­ton Lake, was sentenced on a charge of possession of a controlled substance (marijuana) to 101 days in jail (credit for 101 days) and a total of $348 in court assessments. The sentence is concurrent with a Clinton County sentence and the defendant is to continue with his treat­ment program.

Matthew D. Rouleau, 31, St. Helen, was sentenced to 13 months to four years in prison (no credit) and a total of $948 in court assessments (he is not eligible for special alternative incarceration). He had pleaded guilty to delivery/manufac­ture of marijuana.

Joseph J. Poirier, 29, Houghton Lake, did not enter a plea on charges of assault by strangulation, domestic violence, sec­ond offense, or resisting and obstructing police and a final plea cut-off hearing was set for March 21. A jury trial date was set for April 13-18.

Demarko A. Plain, 37, Flint, pleaded guilty to possession of less than 25 grams of a controlled substance, as amended, and will be sentenced March 21. Dis­missed were charges of possession of a controlled substance (non-narcotic) and driving with a suspended license.

Michael Slingerland, 47, Roscom­mon, pleaded guilty to altering or forg­ing documents and was scheduled to be sentenced March 21.

Corey E. Villella, 24, Prudenville, was sentenced on a charge of resisting and obstructing police to a one-year de­lay of sentence, 12 months probation and a total of $558 in court assessments. Dis­missed were charges of reckless driving and driving with a suspended license.

Jody J. Kowalski, 36, Merritt, was sentenced to 12 months in jail (credit for three days), 24 months probation, a total of $498 in court assessments and $88.64 in restitution on a charge of first degree retail fraud. The judge also signed an or­der amending Kowalski’s probation on another case (probation stemming from a conviction on a charge of larceny of between $1,000 and $20,000) and there was a restitution disbursement payment made to Royal Medical.

Matthew K. Mickens, 43, Houghton Lake, pleaded guilty to probation viola­tion after being taken into custody (he had failed to appear at a probation vio­lation hearing) and was sentenced to 30 days in jail (credit for one day). He will be discharged from probation without improvement.

Edward A. Champine, 37, Port Hu­ron, pleaded guilty to probation viola­tion and was sentenced to six months in jail (credit for 15 days) and will be dis­charged without improvement.
