34th Circuit Court

Judge Robert W. Bennett presided in 34th Circuit Court, Roscommon, March 21:

Nicholas Richardson, 20, Saginaw, charged with two counts of criminal en­terprises and one count of receiving and concealing property over $20,000, is ready for trial, which is to be scheduled for June.

Michael E. Johnson, 35, Houghton Lake, was sentenced on a charge of re­sisting and obstructing police to nine months in jail (credit for 101 days), with the balance of jail time held in abeyance, 18 months probation and a total of $648 in court assessments.

Wayne L. Desilet, 61, Prudenville, was sentenced on a charge of impaired driving, third offense, to six months in jail (credit for 11 days), with the balance held in abeyance, 24 months probation (Sobriety Court program) and a total of $1,358 in court assessments.

Daniel R. Brownell, 48, Flushing, was sentenced on two counts of use of a controlled substance (non-narcotic, one count of driving while intoxicated and one count of ab­sconding/ forfeiting bond. He was sentenced to serve seven days in jail (credit for seven days) on each of the counts, concurrently, 12 months proba­tion and a total of $1,023 in court assess­ments.

Donny A. Hancock, 22, Roscommon, charged with homicide open murder, was denied a motion for ineffective counsel.

Erich C. Meixner, 37 Crystal, plead­ed guilty to possession of less than 25 grams of a controlled substance and was scheduled to be sentenced April 25.

Leonard K. Christopher, 62, Sagi­naw, charged with two counts of crimi­nal enterprises, is ready for trial, which is to be scheduled for June.

Shannon J. Henshaw, 41, Flint, was sentenced on a charge of possession of a fi­nancial transaction device by fraud to 10 months in jail (credit for 79 days), 24 months probation and a total of $498 in court assessments and $158.97 in restitu­tion.

Tera J. Beyer, 26, West Branch, was sentenced on charges of forgery and ut­tering and publishing to two terms of 45 days in jail (credit for 45 days), concur­rent, 12 months probation and a total of $476 in court assessments.

Christopher A. Beard, 34, Richmond, was sentenced on a charge of larceny of firearms to 12 months in jail (credit for 209 days), a total of $1,998 in court as­sessments and $1,292.87 in restitution.

Joseph J. Poirier, 29, Houghton Lake, pleaded no contest to assault by strangu­lation, as amended, and resisting and ob­structing police. Dismissed were charges of domestic violence and malicious de­struction of property between $200 and $1,000. He is to be sentenced April 25.

Daniel C. Tuchel, 49, Houghton Lake, charged with driving with a high blood alcohol content and possession of marijuana is ready for trial, which is to be scheduled for July.

Duane S. Hall Jr., 27, St. Helen, charged with assault by strangulation, domestic violence and interfering with electronic communications, is ready for trial, which is to be scheduled for June.

Victoria Christopher, 56, Saginaw, charged with two counts of criminal en­terprises and one count of receiving and concealing property over $20,000, is ready for trial, which is to be scheduled for June.

Demarko A. Plain, 37, Flint, was sen­tenced on a charge of possession of less than 25 grams of a controlled substance to six months in jail (credit for 10 days), 12 months probation and a total of $498 in court assessments. Dismissed were charges of possession of a controlled substance (non-narcotic) and driving with a suspended license.

Michael L. Kendall, 54, Roscom­mon, was sentenced on a charge of third degree arson to 90 days in jail (credit for one day), with the balance of time to be held in abeyance, 12 months probation, a total of $408 in court assessments and $600 in restitution.

Michael G. Slingerland, 47, Roscom­mon, was sentenced on a charge of alter­ing or forging documents to a one-year delay of sentence, 12 months probation and a total of $1,258 in court assess­ments.

Robert M. Ii, 39, St. Helen, was sen­tenced on a charge of domestic violence to five months in jail (credit for 61 days), 18 months probation and a total of $498 in court assessments. He may be released directly to in-patient treatment or mental health programming and if any jail time remains, it will be held in abeyance.

Robert L. Bailey III, 36, West Branch, was denied a motion to withdraw his no contest plea (and be remanded to District Court) on a charge of domestic violence and was sentenced to 19 months to five years in prison (no credit), consecutive to parole status, and a total of $948 in court assessments.

Aaron P. Mainprize, 37, St. Charles, pleaded guilty to filing a false report of a felony (as amended) and is to be sen­tenced April 25.

Antonio D. Miller, 22, Prudenville, pleaded guilty to breaking and entering with intent and is to be sentenced April 25.

Michael P. Nester, 29, Davisburg, was sentenced to three concurrent terms of eight months in jail (credit for 237 days) for third degree fleeing and elud­ing and probation violation in associa­tion with charges of breaking and enter­ing with intent and possession of stolen property. He was discharged from proba­tion without improvement.

James R. Phillips, 55, Houghton Lake, is ready for trial and a final plea cutoff hearing and jury trial have been scheduled. He is charged with operat­ing or maintaining a lab involving meth­amphetamine, purchasing ephed­rine/ pseudo­ephedrine to make meth, two counts of soliciting another to obtain ephedrine/pseudo­ephedrine, three counts of possession of a con­trolled substance (non-narcotic), one count of possession of a controlled substance (mari­juana), one count of maintaining a drug house and two counts of bringing contraband into prison.
